Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Nynch ("Company", "we", "us", or "our") concerning your access to and use of the Nynch platform and services. By accessing or using our services, you agree to be bound by these terms.

2. Intellectual Property

Unless otherwise indicated, the site and services are our proprietary property. All source code, functionality, software, website designs, text, photographs, and graphics are owned or controlled by us. No part of the site may be copied, reproduced, or commercially exploited without our express prior written permission.

3. User Representations

By using our services, you represent and warrant that:

  • All registration information you submit is true, accurate, and complete
  • You will maintain the accuracy of such information
  • You have the legal capacity to agree to these Terms
  • You are not a minor in the jurisdiction in which you reside
  • You will not access the services through automated or non-human means
  • Your use of the services will not violate any applicable law or regulation

4. User Registration

You may be required to register with the site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username we determine to be inappropriate or objectionable.

5. Prohibited Activities

You agree not to:

  • Systematically retrieve data to create or compile a collection or database
  • Make any unauthorised use of the services, including collecting email addresses by electronic means
  • Circumvent, disable, or interfere with security-related features of the site

6. Subscriptions and Billing

Some parts of the service are billed on a subscription basis, typically monthly or annually. A valid payment method is required. By submitting payment information, you authorise us to charge all subscription fees to that payment instrument.

7. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation, your subscription remains active until the end of your current billing period. No refunds are provided for the remaining time in the current billing period.

8. Limitation of Liability

In no event will we or our directors, employees, or agents be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the site. Our liability to you will at all times be limited to the amount paid by you to us during the six (6) month period prior to any cause of action.

9. Indemnification

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, or claim arising from your Contributions, your use of the site, or any breach of these Terms.

10. Data Protection

11. Governing Law

These Terms shall be governed by the laws of England and Wales. You irrevocably consent that the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute arising in connection with these terms.

12. Modifications

We reserve the right to change, modify, or remove the contents of the site at any time at our sole discretion without notice. We will not be liable for any modification, price change, suspension, or discontinuance of the services.
